Order, In re Accuracy Concerns Regarding FBI Matters Submitted to the FISC, No. Misc. 19-02, GID.C.00297 (FISA Ct. May 22, 2023) (Trenga, J.)
Modifies reporting requirements re: FBI technical improvements to FISA process. Mar. 5, 2020 order required tech improvements to process of preparing FISA applications/verifying information to be reported every 30 days; June 23, 2020 extended to every 90 days. Current motion sought relief from quarterly reporting. Gov’t reported work complete on (i) implementation of secure video teleconference connectivity between FBI field offices and FISC; (ii) new online/virtual training to educate FBI on FISA; (iii) new methods to electronically document/store information re: confidential human sources (CHS). New FISA-related workflow created on Bridge platform, tested in 5 field offices/HQ. Aim is to fully implement by end FY2023. Court considered motion as fulfilling June reporting, requested further report due Oct. 13, 2023 on tech improvements for process of preparing apps/verifying info. If Bridge not completed by then, subsequent reports every 90 days thereafter. Further required declassified copies of the Motion and Order for public release.
