Opinion and Order, In re Motion for Consent to Disclosure of Court Records or, in the Alternative, A Determination of the Effect of the Court’s Rules on Statutory Access Rights

Finding that contrary to the Government’s argument in District Court, that FISC rules prevent the District Court from ordering disclosure of a FISC opinion if it is found to be subject to FOIA, the District Court has the authority to do so.

Order grants EFF's motion in part, allowing the disclosure of the opinion if authorized by the District Court.
