Letter to Patrick J. Leahy, Chairman, Senate Comm. on the Judiciary

Judge Walton responded to Senator Leahy’s request for information regarding certain operations and procedures of the FISC. Judge Walton provided descriptions ofthe process by which the Court reviews applications from the government for orders for electronic surveillance under Title I of FISA, access to business records under Title V of FISA, and submissions from the government under Section 702 of FISA. Judge Walton also described the process through which the Court interacts with the government in reviewing applications, ways in which nongovernmental parties may appear before the Court, and the process by which the Court ensures compliance with its orders.
